I am commanded by the Army Council to acknow-
ledge the receipt of your letter of the 16th October last, No. 33936/1908, on the subject of the amount with which the War Department should be credited in the Hong Kong Military Land Account on the disposal of the lease of a property in Spring Gardens, Hong Kong.
The Army Council agree with the Earl of Crewe that the War Department paid a less sum for the lease
because the property was subject to a Crown Rent and
that, for the same reason, they will receive a less sum
for the property, if the lease is sold. These facts,
which would be equally true if a private individual end not the War Department had bought or sold the lease, are entirely independent of the relations between the
War Department and the Colonial Government, and do not
in any way affect the Colonial revenue.
But, because the property was required for
military purposes, the Colonial Government agreed, as a
separate transaction, to waive the Crown rent of £150
